1. Acceptance

By installing or using Lunaria (the "App") you agree to these Terms of Service. If you do not agree, do not install or use the App.

2. Service Description

The App is an AI-assisted dream journaling tool that records your dreams, generates symbolic interpretations, supports follow-up questions, and optionally produces dream artwork via third-party AI models. Interpretations and AI outputs are intended as reflective, symbolic, and entertainment-oriented content.

3. Eligibility

You must be at least 16 years old (or the applicable age of digital consent in your jurisdiction, if higher) to use the App. This matches the App Store age rating and our Privacy Policy.

4. Subscriptions and Credits

The App offers two purchase types via Apple StoreKit:

Free users receive 3 lifetime free interpretations.

Subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before the end of the period via your Apple ID. The renewal price is charged to your Apple ID. To cancel, go to Settings → Apple ID → Subscriptions on your device.

Refund and cancellation policies are governed by Apple's terms: https://www.apple.com/legal/internet-services/itunes/. Consumable credit purchases are generally non-refundable per Apple policy.

5. AI-Generated Content

Interpretations, follow-up answers, and dream artwork are generated by third-party AI models (OpenAI, Google Gemini). These outputs:

7. Privacy

8. Disclaimers

The App is provided "as is" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that AI outputs will be accurate, useful, or safe.

9. Limitation of Liability

To the fullest extent permitted by applicable law, the operator's total aggregate liability arising out of or related to the App shall not exceed the amount you paid to the operator in the twelve (12) months preceding the claim, or USD 50, whichever is greater. We are not liable for indirect, incidental, consequential, or punitive damages.

10. Changes to These Terms

We may revise these Terms at any time. Material changes will be surfaced in the App and require your acknowledgement before continuing to use paid features. The effective date at the top reflects the most recent revision.

11. Termination

You may stop using the App at any time and delete your local data via Settings → Delete Account. Subscriptions continue until cancelled via Apple. We may terminate or suspend access for material violations of these Terms.

12. Governing Law

These Terms are governed by the laws of İstanbul, Türkiye. Disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of İstanbul, Türkiye, unless mandatory consumer protection laws of your country of residence provide otherwise.

1. Kabul

Lunaria'yı ("Uygulama") yükleyerek veya kullanarak bu Kullanım Koşullarını kabul etmiş sayılırsınız. Kabul etmiyorsanız Uygulamayı yüklemeyiniz veya kullanmayınız.

2. Hizmet Tanımı

Uygulama, rüyalarınızı kaydetmenize, sembolik yorumlar üretmesine, takip soruları sormaya ve opsiyonel olarak üçüncü taraf yapay zekâ modelleri ile rüya görseli oluşturmaya imkân tanıyan bir AI destekli rüya günlüğüdür. Yorumlar ve AI çıktıları düşündürücü, sembolik ve eğlence amaçlı içeriklerdir.

3. Kullanım Yaşı

Uygulamayı kullanabilmek için en az 16 yaşında olmanız (veya yargı bölgenizde geçerli dijital onay yaşı daha yüksekse onun üzerinde olmanız) gerekir. Bu yaş, App Store yaş sınırımız ve Gizlilik Politikamız ile aynıdır.

4. Abonelik ve Kredi

Uygulama, Apple StoreKit üzerinden iki tür satın alma sunar:

Ücretsiz kullanıcılara ömür boyu 3 ücretsiz yorum hakkı verilir.

Abonelikler her fatura döneminin sonunda otomatik yenilenir; iptal etmek için fatura döneminin bitiminden en az 24 saat önce Apple ID'niz üzerinden iptal etmelisiniz. Yenileme bedeli Apple ID'nize tahsil edilir. İptal için cihazınızda Ayarlar → Apple ID → Abonelikler.

İade ve iptal politikaları Apple'ın koşullarına tabidir: https://www.apple.com/legal/internet-services/itunes/. Sarf edilebilir kredi satın alımları Apple politikası gereği genellikle iade edilemez.

5. AI Tarafından Üretilen İçerik

Yorumlar, takip yanıtları ve rüya görselleri üçüncü taraf yapay zekâ modelleri (OpenAI, Google Gemini) tarafından üretilir. Bu çıktılar:

Rüya metninizin sahipliği size aittir. AI tarafından üretilen çıktılar kişisel kullanımınız için sunulur; bu çıktılar üzerinde mülkiyet iddiasında bulunmuyoruz.

6. Kabul Edilebilir Kullanım

Uygulamayı şu amaçlarla kullanmayacağınızı kabul edersiniz:

Bu koşulları ihlal eden kullanıcıların erişimini askıya alma veya sonlandırma hakkımız saklıdır.

7. Gizlilik

Verilerinize ilişkin yaklaşımımız [Gizlilik Politikası](privacy-policy-tr.md)'nda açıklanmıştır. Türkiye'de ikamet ediyorsanız ayrıca KVKK Aydınlatma Metni'ne bakınız.

8. Sorumluluk Reddi

Uygulama "olduğu gibi" sunulmaktadır; ticari elverişlilik, belirli amaca uygunluk veya ihlal etmeme dahil olmak üzere hiçbir açık veya zımni garanti verilmez. AI çıktılarının doğru, faydalı veya güvenli olacağını garanti etmiyoruz.

9. Sorumluluk Sınırlaması

Yürürlükteki yasanın izin verdiği ölçüde, işletmecinin Uygulamadan kaynaklanan veya Uygulamayla ilgili toplam sorumluluğu, talep tarihinden önceki on iki (12) ayda işletmeciye ödediğiniz tutarı veya 50 ABD Doları'nı (hangisi yüksekse) aşamaz. Dolaylı, arızi, sonuç olarak ortaya çıkan veya cezai zararlardan sorumlu değiliz.

10. Koşullarda Değişiklik

Bu Koşulları herhangi bir zamanda revize edebiliriz. Önemli değişiklikler Uygulama içinde yüzeylenir ve ücretli özelliklere devam etmeden önce onayınızı gerektirir. En üstteki yürürlük tarihi son revizyonu yansıtır.

11. Sona Erdirme

Uygulamayı dilediğiniz zaman bırakabilir ve Ayarlar → Hesabı Sil ile yerel verilerinizi silebilirsiniz. Abonelikler Apple üzerinden iptal edilene kadar devam eder. Bu Koşulların önemli ihlallerinde erişiminizi askıya alabilir veya sonlandırabiliriz.

12. Geçerli Hukuk

Bu Koşullar İstanbul, Türkiye yasalarına tabidir. Bu Koşullardan doğan uyuşmazlıklarda ikamet ettiğiniz ülkenin tüketici koruma yasaları aksini gerektirmedikçe İstanbul, Türkiye mahkemeleri münhasıran yetkilidir.
